Since our founding, some of our accomplishments
include:
- As lead trial counsel for Sun Microsystems, Inc.in its
antitrust, copyright, and unfair competition suit against
Microsoft, Inc, obtained a preliminary injunction requiring
Microsoft to ship a Sun-compatible, Java Virtual Machine with
each copy of its Windows operating system and Internet Explorer
browser.
- Obtaining, on behalf of Amgen, a ruling from the District
Court of Massachusetts that Transkaryotic Therapies' development
of human erythropoietin infringes three of Amgen's patents on
its best selling anti-anemia drug, Epogen®.
- Obtaining, on behalf of Sun, three preliminary injunctions
against Microsoft Corporation for trademark infringement,
copyright infringement, and unfair competition arising out of
Microsoft's distribution of Windows98 and other products that
incorporate unauthorized implementations of Sun's JAVA®
technology.
- Obtaining judgment that Amgen's activities regarding its
manufacture and sale of Neupogen do not infringe Biogen's U.S.
Patents.
- Affirming on appeal to the Federal Circuit an earlier trial
court judgment on behalf of Sun that invalidated broad patent
claims to methods for exchange of data between incompatible
computers over a network.
- Establishing, on behalf of Amgen, exclusive worldwide
marketing rights to a new $2 billion erythropoietic stimulating
factor following a two-month trial.
